Much
of the work undertaken by P Wilson & Company involves
the resolution of problems relating to land and property;
indeed we like to think of ourselves as problem solvers for
our clients. However, when negotiation fails to achieve a
satisfactory resolution or the opportunity to negotiate does
not arise, disputes may result in referrals to Arbitrators,
Independent Experts, Tribunals, Inspectors or the Courts,
in which P Wilson & Company has extensive experience.
Arbitrator
and Independent Expert Appointments
We have Partners who are
able to accept appointments to act as Arbitrator or Independent
Expert in areas of relevant expertise. Paul Wilson is an experienced
Arbitrator specialising in agricultural holdings law and was
appointed to the Lord Chancellor's Panel of Agricultural Arbitrators
in 1990.
Case Presentation and Management
We are able to present clients'
cases at Arbitrations, Public Inquiries, Tribunal Hearings
and the like.
In cases where expert witness evidence or a legal opinion
may be required, we can provide an appropriate case management
service. As Chartered Surveyors, we are able to obtain legal
opinions from Barristers, on matters within our professional
competence, under the Bar Council's Direct Professional Access
to Barristers scheme. We have good contacts and relationships
with a number of Barristers' Chambers specialising in property,
planning and environmental law and with related professional
firms.
Expert
Witness Appointments
In areas of professional competence,
our Partners receive instructions to provide Expert Witness
evidence before the Courts and at Planning Hearings, Public
Inquiries and the like.
In undertaking the role and duties of an Expert Witness, we
are familiar with the requirements of Part 35 of the Civil
Procedure Rules and, as Chartered Surveyors, we follow the
RICS Practice Statement and Guidance 'Surveyors Acting as
Expert Witnesses'.
